1. Acceptance of Terms

These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("Trader," "you," or "your") and FCTOZ - Funding Crypto Organization ("FCTOZ," "we," "us," or "our"). By registering an account, purchasing a challenge, or using any of our services, you acknowledge that you have read, understood, and agree to be bound by these Terms.

If you do not agree with any part of these Terms, you must not use our services.

2. Definitions

• "Platform" refers to the FCTOZ website, dashboard, and all related services
• "Challenge" refers to the trading evaluation program offered by FCTOZ
• "Funded Account" refers to a trading account provided to successful challenge participants
• "P&L" refers to Profit and Loss statements and reports
• "KYC" refers to Know Your Customer verification procedures
• "Payout" refers to profit distributions made to funded traders
• "Drawdown" refers to the maximum allowed loss from the account balance

3. Eligibility Requirements

To use FCTOZ services, you must:

• Be at least 18 years of age
• Have the legal capacity to enter into binding agreements
• Not be a resident of restricted jurisdictions (as updated from time to time)
• Complete our KYC verification process successfully
• Provide accurate and truthful information during registration
• Not have been previously suspended or banned from our platform
• Comply with all applicable laws and regulations in your jurisdiction

4. Challenge Program

4.1 Challenge Structure

• Challenges are evaluation programs designed to assess trading skills
• Each challenge has specific profit targets, loss limits, and time constraints
• Challenge parameters are clearly stated at the time of purchase
• Challenge rules may not be modified after purchase

4.2 Challenge Rules

• Profit Target: Must achieve the specified profit target percentage
• Daily Loss Limit: Cannot exceed the maximum daily loss percentage
• Time Limit: Must complete challenge within the specified timeframe
• Minimum Trading Days: Must trade for the required number of days
• Trading Platform: Must use TradingView as specified

4.3 Challenge Failure

A challenge is considered failed if:

• Daily loss limit is exceeded
• Time limit expires without meeting profit target
• Violation of trading rules or platform terms
• Fraudulent or manipulative trading behavior is detected

5. Funded Trading Program

5.1 Funding Eligibility

Upon successful completion of a challenge and verification of results, you may be eligible for a funded trading account. Funding is subject to final approval by FCTOZ and completion of all required documentation.

5.2 Profit Sharing

• Initial profit split: 80% to trader, 20% to FCTOZ
• After demonstrating consistency: 90% to trader, 10% to FCTOZ
• Profit splits are calculated based on verified P&L reports
• All trading costs and fees are borne by FCTOZ

5.3 Payout Process

• Payouts are processed within 24 hours on business days
• Minimum payout thresholds may apply
• Payouts are made via USDT (TRC20) to verified wallet addresses
• All payout requests must be accompanied by verified P&L documentation

6. Trading Rules and Restrictions

6.1 Permitted Trading

• All trading strategies are permitted unless explicitly prohibited
• Holding positions over weekends and during news events is allowed
• Use of expert advisors (EAs) and automated trading systems is permitted
• Copy trading and social trading are allowed

6.2 Prohibited Activities

• Tick scalping and latency arbitrage
• News trading within 2 minutes of high-impact news releases
• Account sharing or allowing third parties to trade your account
• Creating multiple accounts to circumvent rules
• Any form of market manipulation or fraudulent activity
• Using exploits or glitches in the trading platform

6.3 Risk Management

• Maximum position size limits may apply
• Correlation limits between positions may be enforced
• Overnight and weekend position limits may apply to funded accounts
• Stop-loss requirements may be mandatory for certain instruments

7. Payments and Fees

7.1 Challenge Fees

• Challenge fees are clearly displayed and must be paid in full before account activation
• Challenge fees are non-refundable except as specified in Section 7.3
• Prices may change without notice for future challenges
• All fees are in USD unless otherwise specified

7.2 Payment Methods

We accept various payment methods as displayed during checkout. All payments are processed securely through our authorized payment providers. You are responsible for any transaction fees charged by your payment provider.

7.3 Refund Policy

• Challenge fees are refunded in full with your first payout as a funded trader
• No other refunds are provided unless required by law
• Chargebacks or payment disputes may result in account suspension
• Processing fees and transaction costs are non-refundable

8. Account Management

8.1 Account Security

• You are responsible for maintaining the confidentiality of your account credentials
• Two-factor authentication is strongly recommended
• You must notify us immediately of any unauthorized account access
• We are not liable for losses resulting from unauthorized account use

8.2 Account Information

• All account information must be accurate and up-to-date
• You must update your information if it changes
• False or misleading information may result in account termination
• KYC verification is required before receiving any payouts

8.3 Account Suspension and Termination

We may suspend or terminate your account for:

• Violation of these Terms and Conditions
• Fraudulent or suspicious activity
• Failure to complete KYC verification
• Chargeback or payment disputes
• Extended inactivity (over 12 months)

9. Intellectual Property

All content, software, and materials on the FCTOZ platform are owned by FCTOZ or its licensors and are protected by intellectual property laws. You may not reproduce, distribute, modify, or create derivative works without our express written permission.

The FCTOZ trademark, logo, and brand are the exclusive property of FCTOZ and may not be used without authorization.

10. Disclaimers and Risk Warnings

• FCTOZ does not provide investment advice or recommendations
• All trading decisions are made solely by the trader
• Market conditions can change rapidly and unpredictably
• Technical issues may occur that could affect trading performance
• Regulatory changes may impact the availability of our services
• No guarantee of profitability or success in the challenge program

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FCTOZ SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR THE USE OF OUR SERVICES.

Our total liability to you for all claims arising out of or relating to these Terms shall not exceed the amount you have paid to FCTOZ in the twelve (12) months preceding the claim.

12. Indemnification

You agree to indemnify, defend, and hold harmless FCTOZ, its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, expenses, or fees arising out of or relating to your use of our services, violation of these Terms, or infringement of any third-party rights.

13. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of [Jurisdiction], without regard to its conflict of law provisions. Any disputes arising out of or relating to these Terms shall be resolved through binding arbitration in accordance with the rules of [Arbitration Organization].

You waive any right to a jury trial and agree not to participate in class action lawsuits against FCTOZ.

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
